Opencare Inc. (“Opencare,” “we,” or ”us”) operates the Opencare Referral Program (the “Program”) to reward both registered members (a “Member”) and affiliated health care providers (a “Provider”) for referring others to use Opencare’s services. By participating in the Program, you can earn rewards for yourself and your referred individuals.
By participating in the Program, you (“you” or “your”) agree to these Referral Terms and Conditions (“Terms”). Your participation also signifies your acceptance of Opencare’s Terms of Use and Privacy Policy. In case of any conflict, these Referral Terms will prevail. All decisions by Opencare are final and binding.
Opencare’s Terms of Use include an arbitration provision and a class action waiver, which apply to your participation in the Program. By participating, you agree to resolve any disputes through arbitration and waive your right to join a class action lawsuit against us.
To participate in the Program, you must be a legal resident of the United States or Canada and at least 18 years old. You may not send referral emails to anyone under 18 years old. Participation is prohibited where restricted by applicable laws or regulations.
To join the Program, visit Opencare and follow the on-screen instructions to refer friends, family members, or colleagues (“Friends”). The instructions will specify the reward amount, which will be offered as a pre-paid gift card (the “Gift Card”), subject to the issuer’s terms and conditions.
By providing an email address or Program link, you confirm that you know the recipient and genuinely believe they would be interested in the Gift Card. Ensure you have any necessary consent to send these communications.
For Members: When your Friend clicks on their referral link, requests an appointment with a new dentist, and attends a standard appointment (confirmed by the dentist), you will receive a unique referral link for your Gift Card. Your Friend will also receive a unique referral link for their Gift Card.
You can refer as many Friends as you like. Each referral must include your unique referral link. Friends must use this link to sign up or use Opencare services for you to earn a Gift Card. Referrals must be real individuals who meet these Terms. If a Friend receives multiple referral links, only the link used will result in a Gift Card for the corresponding Member or Provider.
You must only send legitimate invitations to real people you know. Self-referrals, creating fake accounts, or impersonating others to participate in the Program is prohibited. You cannot refer anyone who has submitted an Opencare appointment request before using your referral link or anyone who has claimed a reward before. You must not use the Program in any way that is illegal, harassing, harmful, or outside the spirit of the Program. This includes:
You are responsible for sending invitation messages and must comply with applicable laws, including anti-spam regulations. Bulk distribution or sending referrals to strangers is prohibited and may result in termination from the Program. Non-compliance may require you to indemnify Opencare for any resulting liabilities, costs, or expenses.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
Opencare reserves the right to suspend or terminate the Program or your participation at any time for any reason. We may revoke Gift Cards or suspend accounts for suspected abuse or fraud. We may delay Gift Card issuance for investigation purposes. All referral activities are subject to review and adjustments at our discretion.
Participation in the Program does not confer any contractual rights. Gift Cards and benefits provided by Opencare are discretionary gifts and not earned entitlements. Participants cannot claim legal rights based on their involvement in the Program.
Opencare may update these Terms without prior notice. It is your responsibility to review the Terms periodically. Continued participation after any changes indicates your acceptance of the updated Terms.
